These Terms of Service ("Terms") form a binding agreement between you and Rasit Erol ("we", "us", or "our") and govern your use of the CulturEnglish mobile application (the "App"), distributed on Google Play and the Apple App Store under the package identifier com.culturel.english.
By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
The App is intended for a general audience and is not directed to children. You must be at least the age of digital consent in your jurisdiction to create an account. If you are a minor under applicable law, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
CulturEnglish provides English-language learning content and features, which may include daily reading texts, grammar lessons, a dictionary, a daily "spin wheel", downloadable story books, gamification (experience points, levels, streaks, badges), in-app currencies, optional social/friends features, and a premium subscription.
We may add, change, suspend, or remove features at any time. The availability of specific content may vary by region.
The App offers an optional auto-renewing premium subscription ("Pro").
Virtual currency and items have no monetary value, grant only a limited, personal, non-transferable, revocable license to use them within the App, may not be sold or transferred between accounts, and (except where required by law or store policy) are non-refundable. If your account is terminated for breach of these Terms, any unused virtual currency and items are forfeited without refund. All real-money charges are processed by Google or Apple; we do not receive or store your full payment details.
You agree not to use the App unlawfully; reverse-engineer or bypass security, payment, or currency mechanisms; exploit bugs or use cheats; harass, abuse, impersonate, or harm other users; upload illegal, infringing, or offensive content; or access another user's account without authorization. We may suspend or terminate accounts that violate this section.
If you set a display name, profile photo, or interact through social/friends features, you are responsible for that content and grant us a limited license to host and display it as needed to operate the relevant features. We may remove content that violates these Terms.
The App and all of its content are owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the App for your own non-commercial learning. You may not copy, distribute, modify, or create derivative works except as expressly permitted.
The App relies on third-party services, including Google Firebase, Google Play Billing, and the Apple App Store. Your use of those services is also subject to their respective terms and privacy policies.
Your use of the App is also governed by our Privacy Policy, which explains how we collect and process your data.
The App is provided "as is" and "as available" without warranties of any kind. We do not warrant that the App will be uninterrupted, error-free, or that it will produce any particular learning outcome. To the extent any warranty cannot be excluded by law, it is limited to the minimum permitted.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, progress, virtual currency, or profits. Our total liability for any claim relating to the App is limited to the amount you paid us in the twelve (12) months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
You may stop using the App and delete your account at any time, directly inside the App under Profile > Delete Account. We may suspend or terminate your access if you breach these Terms or if we discontinue the App.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the Republic of Turkiye, without regard to conflict-of-laws rules. Any disputes will be subject to the courts of Ankara, Turkiye, except where mandatory consumer-protection law in your country of residence provides otherwise.
